Welcome to the Privacy Policy for Colbrook Kitchen. Users of our website (the "Site") are provided with a variety of information and services, including search capabilities, access to reviews, the ability to submit reviews for other users, and shopping opportunities, including Frequent Buyer Incentive Programs (collectively, the "Colbrook Kitchen Service"). By using the Site, you are agreeing to comply with and be bound by this Privacy Policy. Please review the Privacy Policy carefully. We reserve the right to modify the Privacy Policy at any time, and without prior notice, by posting the amended Privacy Policy on the Site. Your continued use of the Colbrook Kitchen Service indicates your acceptance of the amended Privacy Policy. If you do not agree with the Privacy Policy at any time, then you may “opt-out” and terminate your relationship with us. If you subsequently establish a new relationship with the Site, then it will be subject to the then-current Privacy Policy.

This Privacy Policy applies to your use of the Colbrook Kitchen Service, including access to the Site. It will tell you how and why we collect, store, and use information about you, and describe your rights to review and, if you wish, to delete that information.

INFORMATION COLLECTION, RETENTION, AND PROCESSING

Personally Identifiable Information (“PII”) is defined as information that specifically identifies you, as an individual, or as an organization, including your name, e-mail address, and certain online identifiers such as IP addresses and cookies.

We only collect your PII after you have specifically and knowingly provided that information to us. By voluntarily providing this information to us at various points when using the Site, including but not limited to, sending us a comment or suggestion, subscribing to our newsletters, or purchasing a product on the Site, you consent to our collection and use of your PII for that online activity. You are under no affirmative obligation to provide this information to us and you may access many features of the Colbrook Kitchen Service without providing any PII.

If you initiate a transaction to purchase of goods or services through the Site, then we will need additional PII, including your mailing address and telephone number. All payments for purchases through the Site must be made by credit card but you may checkout as a ’guest’: without creating an account. We use a third party payment processor to obtain authorization to charge your credit card and your credit card information is used only for a single transaction: we do not collect or retain your credit card number in your account. Any subsequent refunds or credits relating to that single transaction are processed through the third party processor.

Our third party hosting service is PCI-compliant and your PII is stored in a highly secure environment. We retain a record of all our customers for as long as we are required by applicable statutes of limitation, under state, federal, and international law. 

We do not collect any “special categories” of PII (as defined in Article 9 of the General Data Protection Regulation of the European Union - also known as the “GDPR”) and we do not use your PII in any automated decision-making.

We do collect non-personally identifiable information, which is information that does not identify you personally, but that becomes available to us as a result of your visit to our Site. This information may include, without limitation, your country, your IP address [a number assigned to your computer by your network or internet service provider], your Internet Service Provider, and your Web Browser.

We use this non-personal information primarily as a diagnostic and administrative tool for identifying system problems, administering the Site, and similar technical matters relating to the Site. Much of this is done through the use of cookies on the Site. Cookies are small text files that your web browser leaves on your hard drive to recognize you as a repeat user of our Site. If you do not want cookies to be used, then you can access the features of your web browser for a procedure to disable the cookies. 

We also collect non-personal information in a non-identifying, anonymous and aggregate form to enhance our Site design, to share with advertisers, and for statistical purposes. These statistics and reports will contain only aggregated information and do not include any PII.

OUR PURPOSES FOR COLLECTING INFORMATION FROM YOU 

If you visit the Site and create an account, purchase goods or services through the Site, or participate in any other online activity on the Site, then your PII will be used only for the purposes of the online activity that you authorize.

We will use you PII only for the following purposes; although we may expand our uses in ways that are compatible with these purposes, we will not process your PII for any other purposes without notifying you of such changes to this Privacy Policy:

  • To process transactions for the purchase of goods or services through the Site.

  • To provide requested information to you, such as a password, or to provide technical or customer support relating to your use of the Site or a transaction you initiated on the Site.

    To diagnose technical problems, and to administer the Site in order to constantly improve the quality of the Site and your experience using the SIte. 

At the time that you initially setup your account, you are consenting to enroll to receive marketing and other non-critical communications from us, from time to time. You also may opt to receive marketing communications from us without having registered, created an account, or entered into a transaction with us. You may opt out of receiving such communications at any subsequent time by logging into your Account and editing your Personal Information and preferences within your Account. You can view your updated profile to confirm your edits have been made. Furthermore if you request technical support, you consent to remote accessing and review of the computer that you use to access the Site, solely for purposes of support and debugging.

DISCLOSURE OF YOUR PII

We will not sell, rent or grant access to your PII to any other party without your consent. However, we may be required by law to disclose personal information without your consent in the event of emergency situations or when required by government or other legal authority.

We also may disclose your PII to third parties in connection with a corporate reorganization or merger, or in connection with a sale of all or substantially all of our assets, provided that the PII disclosed continues to be used for the purposes permitted by this Privacy Policy by the entity acquiring this information. 

Please be advised that when you voluntarily disclose information on public areas of the Site, your PII and other information disclosed in your communication may become public information and can be collected and used by other parties. We cannot control what third parties collecting your PII in the public areas of the Site will do with your personal information.

WHEN DISCLOSURE IS REQUIRED

We cannot ensure that your private communications or any PII will not be disclosed to third parties. For example, third parties may unlawfully intercept or access transmissions or private communications.  Additionally, we can (and you authorize us to) disclose any information about you to law enforcement or other government officials as we, in our sole discretion, believe necessary or appropriate to investigate or resolve possible problems or inquiries relating to the Colbrook Kitchen Service.

Special Provisions for Residents of The European Union

Colbrook Kitchen is a “Small Business” within the definitions in the laws of the United States, and is located solely in the State of California: it has no presence of any kind in any Member State of the European Union. All product purchase transactions through the Site occur in the State of California and those products are delivered in California to your shipping agent, that you paid for in connection with your purchase. SAFEGUARDS WE HAVE IN PLACE

We employ reasonable managerial and technical measures to protect your PII. For example, all PII is maintained behind a firewall. In addition, Colbrook Kitchen uses server authentication, data encryption, encoded session identifications, and other advanced technology to prevent interference or unauthorized access to the Site by outside intruders.

CHILDREN 

Minors in the country, state or province in which they live, may use the Site only in accordance with applicable laws in their respective country or state, and in any case, only with the approval of a parent or guardian.

CHANGES TO THIS PRIVACY POLICY  

We may change this Privacy Policy as new policies or services are added or old ones are materially changed. Such changes will be effective when a notice of the change is posted on the Site. Please check the Site from time to time for updates to the Privacy Policy by checking the date of the “Last Update” at the top of this document.

MISCELLANEOUS

If, at any time after you have provided information to us, and you have changed your mind about receiving information from us or about sharing your information, or if you wish to correct any information in your account, then you either may return to your account and change your information or preferences, or send an email that specifies your request.  Please send your request to [email protected].

If any provision of this Privacy Policy is held to be invalid or unenforceable by a tribunal of competent jurisdiction, then that provision shall be construed in accordance with applicable law as nearly as possible to reflect the original intentions of Kochloeffel LLC and all other provisions shall remain in full force and effect.

This Privacy Policy shall be governed by and construed in accordance with the laws of the State of California, including its laws governing security breach notifications, but without regard to its conflicts of law provisions.
